Professional Accomplishments

  • Successful in overturning the trial court decision in Van Coller v. Massieon Farms
    • Issue of whether claimant, arguably in the country illegally and arguably without the legal capacity to enter into a valid contract of employment, was entitled to a work disability award
    • Trial court awarded work disability
    • On appeal, Mike convinced the Kansas Workers’ Compensation Appeals Board that claimant was entitled to nothing more than his functional impairment
    • This establishes case law favorable to employers on whether   an illegal alien is entitled to a work disability
