Professional Accomplishments

  • 22 years as primary defense counsel for group funded Workers Compensation Pool consisting of 60 non-profit nursing homes together with third-party administration through Thomas McGee Group
  • Presenter and annual KING Workers Compensation Seminar 2008 to present
  • Litigation on behalf of family wronged by national building contractor for breach of contract and violations of the Kansas Consumer Protection Act. The claim involved construction deficiencies that destroyed the structural integrity of the structure along with subsequent deceptive acts. Jury verdict for the plaintiff, including an award for lost business revenue (family business) and attorney’s fees; verdict was confirmed by the Court of Appeals and Supreme Court proceedings much to the dismay of the Defendant who had boasted about having “never lost in court.”
  • Arbitration on behalf of real estate purchaser mislead by home inspector who attempted to hide behind a contractual limitation of liability provision that would have limited recovery to $568. Received arbitration award of $568, plus $9,196.50 in attorney fees, plus $60,000 to repair and stabilize a house with serious structural issues.
  • Worked for firm who acted as local counsel in litigation on behalf of State of Kansas against 5 tobacco companies. Helped formulated a legal argument leading to a court order requiring the tobacco companies to disclose thousands of documents that were withheld under a “joint defense privileged.” Kansas was the first and only state in the multi-state litigation to obtain a court order requiring disclosure of the highly sensitive document. The case settled soon thereafter for $262 Billion.
  • Litigation defending municipality against general contractor’s claim for an alleged $459,103.37 in additional costs for purported delay and impact damages in the new construction of water treatment plant. (Case settled; municipality paying contract balance less $72,000 for liquidated damages and no additional costs).
  • Litigation involving defense of general contractor on project involving design deficiencies that lead to negative building pressure and water infiltration.
  • Litigation against owner and architect to recover delay and impact costs associated with defective plans and specifications. Case involved architect, engineer and accounting experts to prove respective standards of care and damages for dispute involving 900+ RFIs and 600+ PCOs.
  • Litigation by against architect/construction manager for negligent and deficient accounting practices. Case involved an architect that contracted with owner as a construction manager. Due to negligently accounting, the CM exceeded a GMP contract with owner. Job-cost analysis of accounting records revealed the CM’s errors and confirmed liability to impacted contractors.
  • Litigation between general contractor and subcontractor involving delay and impact damages arising from problems encountered during directional drilling project for large gas pipeline.
